Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Game (the “Game”), a private, invite-only browser game operated personally by Eyal Shaham (the “Operator”, “we”, “us”). By signing in or otherwise using the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.

1. Eligibility and access

The Game is offered only to people we have explicitly invited. Access is granted by signing in with Google using an email address on our invite list. We may add or remove people from the invite list at any time, at our sole discretion, and access may be revoked without notice. You must be old enough to form a binding agreement under the law of your country.

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and play the Game for your own personal entertainment. You may not sell, sublicense, or commercially exploit the Game or any part of it.

The Game may include names, characters, artwork, or other material associated with third parties, which remain the property of their respective rights holders. The Game is not affiliated with, sponsored by, or endorsed by those rights holders. If you are a rights holder and have a concern, please contact us and we will respond promptly.

Original code and original assets created for this project remain the property of the Operator. Nothing in these Terms transfers ownership of any intellectual property to you.

5. Availability

The Game is provided on a best-effort basis. We may change, suspend, or discontinue it (in whole or in part) at any time, and we do not guarantee any level of uptime, support, or data preservation. Gameplay state is generally not persisted.

6. Disclaimer of warranties

The Game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of (or inability to use) the Game. The Operator’s total liability for any claim relating to the Game is limited to the amount, if any, you paid to use the Game. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

8. Termination

We may suspend or terminate your access at any time, including by removing your email from the invite list. You may stop using the Game at any time. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, and limitation of liability) will continue to apply.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and you may be asked to re-confirm the updated Terms before continuing to use the Game. Continued use after a change means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict of laws rules. The competent courts of Israel will have exclusive jurisdiction over any dispute, except where mandatory local consumer law gives you the right to bring proceedings elsewhere.
